In a recently filed class action lawsuit, ViroPharma and certain of its officers and directors were charged with violating certain provisions of the Securities Exchange Act of 1934. Notably, the complaint alleges that defendants' misrepresented and/or failed to disclose that (1) ViroPharma had no basis for its stated belief that a new supplemental drug application ("sNDA") approval for Vancocin would qualify for three additional years of exclusivity; and (2) generic Vancomycin capsules would not be approved during that time. However, on April 10, 2012, ViroPharma announced that the sNDA approval would not qualify for three additional years of exclusivity, and that the FDA indicated that it was approving three applications for generic Vancomycin capsules. As a result of the announcement, ViroPharma shares dropped by 22%.
