"Madam Justice Elizabeth Bennett has determined that communications that took place at the highest level of the B.C. government between 2001 and 2004 could contain evidence relevant to the case she is hearing concerning the $1-billion sale of BC Rail, a provincial Crown corporation, in 2003," Mark Hume wrote in The Globe and Mail this week.

To obtain that evidence, the judge on Monday ordered Premier Gordon Campbell and other cabinet ministers to turn over e-mails from the years in question - e-mails the government says it can't recover.

It's the latest twist in the slowly unfolding saga of the sale of BC Rail, which at every turn looks worse for Mr. Campbell's government. Since two ministerial aides, Bob Virk and Dave Basi, had documents seized from their offices in the provincial legislature in 2003, opponents of the BC Liberals have been making political hay over backroom dealings in the privitazation of the utility.

Mr. Basi and Mr. Virk are accused of leaking details about the pending rail deal to a Victoria lobbying firm that was representing a rival bidder to CN Rail.
