The union representing Mississauga Transit workers is claiming a bus driver was suspended for five days for using the washroom while on duty.

It says the driver was cited by the company for "deliberate delay of service for using washroom facilities."

ATU Local 1572 president Nicholas Bye says that during a hearing the company argued that allowing every operator to use the bathroom and be late would create chaos.

But Mr. Bye says that amounts to a serious violation of drivers' human rights.

The union also says there is research that shows an extreme urge to use the bathroom can have cognitive effects similar to 24 hours without sleep or a .05 blood alcohol content.
