Crown on hook over sentencing youths
The Crown must bear the burden showing that a youth convicted of a serious violent offence ought to be sentenced as an adult, the Supreme Court of Canada ruled in a 5-4 decision on Friday.
It said that automatically merging the most serious young offenders into the adult justice system flies in the face of a long-standing philosophy of the Youth Criminal Justice Act that the maturation process is an important factor to be taken into account.
