A former all-star running back with Calgary Stampeders who was ordered to spend 90 days in jail on weekends for an assault conviction will not face stiffer punishment.
The Alberta Court of Appeal has rejected an attempt by the Crown to have Joffrey Reynolds serve two to three years behind bars.
Reynolds was found guilty earlier this year of assault causing bodily harm, common assault and unlawfully being in a dwelling after trying to choke and smother his former girlfriend in July 2012.
Two of the three appeal court justices ruled that the trial judge made no errors in law when passing sentence on Reynolds, who won a Grey Cup with Calgary in 2008.
But Justice Peter Martin, the third panel member, ruled that the sentence wasn't reflective of the seriousness of the offence and said a nine-month jail term would have been appropriate.
Reynolds's lawyer said at the sentencing in May that his client would likely be removed from Canada and sent home to the United States once his sentence is complete.
