An assault charge has been withdrawn against former NHL enforcer Bob Probert, who had been accused of brawling with police at his southern Ontario home.

The 40-year-old former hockey star had been charged with assault with intent to resist arrest after an incident at his home in July.

Police were called to the lakeshore property after reports he had been drinking and was damaging property.

At the time, police said they tried to arrest Probert for breach of the peace and alleged he resisted arrest and assaulted an officer.

But a lawyer for the former Detroit Red Wing and Chicago Blackhawk player says that videotape surveillance from the home shows no such offences took place.

Pat Ducharme says his client was just "horsing around" when police were called.
