The mother of a toddler tossed in a recycling bin in Winnipeg says the accused is her younger brother.

The 20-year-old woman says a fight broke out in her home early New Year's Day.

She says her younger brother and older brother had been drinking heavily and when a man was chased out of the home, she followed them, fearing for her older brother's safety.

The mom says the last time she saw her 22-month-old daughter, she was playing with her 17-year-old brother.

The 17-year-old is charged with criminal negligence causing bodily harm, abandoning a child, and assault.

The mother said she is thankful the man chased from the home found her daughter in the bin and brought her to safety.

She says she saw her daughter wrapped in a blanket with scratches on her face before the child was taken to hospital.

"She was crying," said the mother, adding the girl has a fractured skull.
